About Custody & Visitation Modifications
When it comes to changing a parenting plan, there are basically two types of modifications:
- A custody modification occurs when the court orders that the current custody arrangement be changed.
- A visitation modification occurs when the court orders that the current visitation schedule be changed.
Generally, a modification of a custody or visitation order will be granted if there has been a substantial change in circumstances since the original order was entered. Substantial changes in circumstances could include a change in the child's environment (e.g. a move to a different state), a change in the child's routine (e.g. a parent's new partner moving in), or a parent's new job necessitating a change in the child's school.
When Do You Need a Modification?
If you have been denied visitation with your child or have been restricted from having your child in your custody, you will need a modification to regain these parental rights. You may also need a modification if you are dealing with a custody or visitation order that does not work for your situation. For example, if you have shared custody with your child's other parent, but the current custody order assigns your child to you on weekends and your child's other parent on weekdays, you may want to ask the court to modify the order to assign your child to you on a full-time basis.
